HarryHurley.com has obtained a true copy of a letter sent to Dan
Gallagher ... The letter is 2 pages in length ... it details the recent NJ
Supreme Court decision relating to Newark City Council and its desire to
have its own attorney, etc.
Attorney
Angelo Genova confirms that there is "No doubt, the Atlantic City Council's
decision to secure its own counsel to provide ongoing advice with respect to its
general governmental and statutory obligations [which the Mayor maintains to be
the exclusive province of the City Solicitor), runs contrary to the Supreme
Court's recent holding."
Further,
Genova wrote Gallagher ... "Because the aforementioned Supreme Court decision is
dispositive of the issue on appeal in this matter, we strongly encourage the
City Counsel, in the interest of time and the City taxpayers' money, to enter
into a Consent Order abandoning your position with regard to the City Council's
right to unilaterally retain separate counsel on a full time basis. In light of
the foregoing decision of the Supreme Court, we also believe the City Council's
legal position at this juncture to be frivolous and patently without merit
pursuant to New Jersey R. 1:4-8. Being so, we have been instructed to pursue all
remedies to secure the reimbursement of fees and costs personally against
members of City Council, their agents and counsel at the conclusion of this
litigation if the settlement along the foregoing lines is not consummated within
twenty-eight (28) days hereof, pursuant to R. 1:4-8(b)(1). Please be guided
accordingly."
This is
not the entire Genova letter ... But, it is the core of the Gallagher situation
...
We cannot
confirm this ... But, we here at HarryHurley.com strongly believe that Dan
Gallagher will be out as City Council Solicitor in the very near future
