The ruling is interesting ... As Atlantic City Revenue & Finance department employee Jack Potts appears to have single handily saved the day for Levy ...
 
Potts has confirmed to the United States Office of Special Counsel that Atlantic City does not receive any federal loans or grants for the beach patrol or communications department. Mr. Pots confirmed that the beach patrol and communications departments are self funded by the City.
 
Potts also officially confirmed that Levy has not held the position of Director of Emergency Management since October, 2003.
 
We can't help but question then, what is Levy's lawsuit against Atlantic City all about?

Ms. Stern concludes in her letter that "Accordingly, Mr. Levy is not covered by the provisions of the Hatch Act, and his current candidacy for Mayor does not violate the Act.
